The clause to break my lease reads, "Resident agrees to pay X dollars to defray Management administrative and marketing costs if resident does either of the following: (1) fails to fulfill the agreed upon term of the Apartment Rental agreement or, (2)fails to deliver a written "Vacate Notice" to management at least 60 days prior to move out." My landlord is telling me that I cannot simply pay the penalty and leave, but that I have to pay two months for the two months notice, and then the penalty fee on top of that. Based on the wording of the termination clause, what am I required to do?

    If you are leaving, prior to the end of your lease, as you indicate, you fall under clause 1 and owe the expenses in addition to the 60 day rental notice period.
