Evidence expected on Holmes' booby trapped apartment

Prosecutors are expected to present witness testimony from FBI and ATF agents regarding accused Aurora gunman James Holmes' booby trapped apartment and the disarming of explosives today, on the second day of his preliminary hearing.

The hearing is essentially a mini-trial as prosecutors present witness testimony and evidence to outline their case against the former neuroscience student.

Holmes, 25, is accused of killing 12 people and wounding 58 when he allegedly opened fire in a crowded midnight showing of "The Dark Knight Rises" on July 20 in Aurora, Colo.

The hearing at the Arapahoe County District Court could last all week. Judge William Sylvester will decide whether the case will go to trial. Holmes' attorneys have not yet said whether they plan on using a insanity defense, in which case Holmes could possibly be deemed unfit to stand trial. Another possibility is that the hearing could set the stage for a plea deal.

If the case does not go to trial, this week's preliminary hearing could be the only opportunity for public testimony and release of information in a case where gag orders and sealed documents have kept much of the evidence and information away from the public.

Testimony today is expected to center around FBI and ATF agents who were sent to Holmes' apartment after the shooting.

Aurora police officer Aaron Blue testified on Monday that when police found Holmes outside the theater after the shooting, he volunteered that he had four guns and that there were "improvised explosive devices" in his apartment. He told officers that they would go off if the police triggered them.

Authorities eventually conducted a controlled detonation at his apartment and used a robot driven by a bomb technician to methodically disable explosive devices.

"It was an extremely dangerous environment. If [someone] had walked in that door, they would have sustained significant injuries or lost their life," Jim Yacone of the FBI told ABC News at the time.

The first day of the hearing was filled with emotionally charged testimony from first responding police officers and the revelation that Holmes bought his movie ticket 12 days before the shooting.

An officer who took the stand also described Holmes as "relaxed" and "detached" when police confronted him just moments after the shooting stopped.

Holmes has been charged with 166 counts of murder, attempted murder, possession of explosives and crime of violence. The district attorney has not decided whether to seek the death penalty, and Holmes' defense team believes Holmes is mentally ill. He has not entered a plea.

A court-imposed gag order days after the shooting has kept many of the details under wraps, so much of the information being discussed in court is new to the public.

The hearing at the Arapahoe County District Court could last all week. At the end, Judge William Sylvester will decide whether the case will go to trial.

Navigating the world of resumes and cover letters is like trying to do an assignment without any guidelines from your professor.

At school, expectations were always more clear cut. If you wrote an organized and well-researched paper, you?d get a decent ? if not a great ? mark.

Job hunting is a different story. Nothing has prepared you for the game of resumes and cover letters. When you don?t hear back from employers after applying, it?s hard to know what needs improvement.

We recently completed a round of hiring at the company I work for and, based on my experience, I?d like to share some resume and cover letter tips that will help you land your next job interview.

1. Pretend you?re on Twitter

If your cover letter was a tweet, what would it say? Get right to the point.

Lose the, ??I?m applying for the ABC position at EFG Corporation that was posted on the student careers website of University XYZ.?

Writing this sentence on Twitter would be a total waste of characters; instead, your cover letter should start with your pitch: ?I?d be a great fit for the ABC position because XYZ.?

Stop saying that you have ?strong analytical skills? and instead analyze the job description, and craft some very concise and compelling statements demonstrating why you should be interviewed.

2. Ditch the R2-D2 vibe

Write a cover letter the way you would write a blog post ? using a human voice.

Read your cover letter out loud. Now read a post from your blog out loud. Notice a difference? Your cover letter is written in a robotic voice that you may think sounds professional. It?s not. You invite employers to check out your blog, yet they won?t click the link because they?ve already seen your writing via your cover letter and, let me tell you, they?re not impressed.

Remove the words ?strong communication skills? and ?strong writing skills? from your application and just write a persuasive cover letter. Walk the walk.

3. Lose your laundry lists

Why does your resume include laundry lists of each daily task you performed for all the jobs you?ve ever had? If you were a part-time receptionist while you were in university, anyone who looks at your resume?will know that you answered the phone. What made you good at this job? How did you stand out?

Recruitment experts rant about this resume problem all the time, yet it came up so often in the round of hiring we just did. According Andy Porter, HR executive and prominent recruitment blogger, candidates should always pitch themselves as accomplishers as opposed to doers.

To land an interview, it?s important that employers see you as a the quarterback as opposed to the kid that gets picked last in schoolyard games. In other words, stop reducing yourself to a laundry list; you?re better than that!

Your achievements are always more compelling. Make achievements the focal point of your resume and cover letter, and cut out the rest.

4. Stop the resume firing squad

We all know the drill: modify a few resume buzzwords, change the company name and job title on your cover letter, and fire off multiple applications into cyberspace.

Instead, opt for a quality-over-quantity approach by applying to a few positions very well. Standing out requires more time than you may be spending right now. The applications we received shortly after we announced a job posting were inferior to the ones which were sent after a few days.

In the end, all of the applicants we interviewed took a bit more time to write something convincing.

Holmes' hearing in theater shootings may serve as 'mini-trial'

CENTENNIAL, Colo. (AP) ? The suspect in the Colorado movie theater killings returns to court this week for a hearing that might be the closest thing to a trial the victims and their families will get to see.

James Holmes, a former neuroscience graduate student, is charged with killing 12 people and injuring 70 by opening fire in a darkened theater in the Denver suburb of Aurora last July.

At a weeklong preliminary hearing starting Monday, prosecutors will outline their case against Holmes, the first official public disclosure of their evidence. The judge will then determine whether to send the case to trial.

Legal analysts say that evidence appears to be so strong that Holmes may well accept a plea agreement before trial. In such cases, the preliminary hearing can set the stage for a deal by letting each side assess the other's strengths and weaknesses, said Laurie Levenson, a former federal prosecutor and now a professor at Loyola Law School in Los Angeles.

Preliminary hearings "are often the first step to resolving the case, a mini-trial so both sides can see the writing on the wall," Levenson said.

Judges rarely throw out a case at this stage because prosecutors must only meet a "probable cause" standard ? much lower than the "beyond a reasonable doubt" standard for a guilty verdict at trial, said Mimi Wesson, a professor of law at the University of Colorado Law School.

Holmes, who faces more than 160 counts including first-degree murder and attempted murder, could have waived his right to a preliminary hearing, allowing lawyers on both sides to prepare for trial. But defense lawyers sometimes go through with the hearing because it gives them a clearer picture of prosecution evidence.

"In this case, I think it likely that the genuine purpose of the hearing would be information-gathering by the defense," Wesson said.

Court officials expect many survivors and family members of the dead to attend the preliminary hearing, along with scores of spectators and reporters. At least two overflow rooms are being prepared where the hearing can be observed by video and audio feeds.

District Judge William B. Sylvester has imposed a gag order on attorneys and investigators, and many court documents have been filed under seal, so little is known about Holmes' path from promising graduate student to suspect in a mass murder.

The few details that have been made public suggest a disturbing descent.

Holmes enrolled in the University of Colorado, Denver Ph.D. program in neuroscience in 2011. In the spring of 2012, authorities say, he began buying weapons, high-capacity magazines, ammunition, explosives and combat gear. At some point in the school year, he began seeing a university psychiatrist. He failed an oral exam on June 7 and withdrew from the university three days later.

He was arrested outside the theater shortly after the July 20 shootings. Federal authorities have said he entered the theater with a ticket and is believed to have propped open a door, slipped out to his car and returned with his weapons.

Hours later, investigators found his apartment booby-trapped with potentially deadly explosives, police said.

In previous hearings ? many witnessed by victims and survivors ? Holmes' appearance and behavior ranged from bizarre to unremarkable. On his first day in court, his hair was a shocking orange-red, his face was covered with stubble and he seemed to be in a daze.

By last week, his hair was a natural-looking brown and he wore a full beard. He sat quietly and seemed to be aware of the proceedings.

Holmes could get the death penalty or life in prison without parole if he goes to trial and is convicted of murder. He could avoid the death penalty if his lawyers argue he is mentally ill or innocent by reason of insanity.

Holmes' mental health is expected to be a major factor whether his case ends in a plea agreement or goes to trial.

His lawyers have told the judge that Holmes was mentally ill, and court records indicate they may call witnesses in the preliminary hearing to testify about his mental health. The defense team has not said whether Holmes would enter an insanity plea.

An insanity plea is different from the competency argument used for Jared Loughner, who pleaded guilty to killing six people and wounding 13, including then-Rep. Gabrielle Giffords, in Arizona in 2011.

A judge ruled in May 2011 that Loughner was mentally incompetent to stand trial and ordered him to undergo psychiatric treatment. After Loughner spent more than a year in treatment, the judge ruled he had become competent, and Loughner accepted a plea agreement that carried a sentence of life in prison without parole instead of execution.

The decision on whether to seek the death penalty will be up to the new district attorney for Arapahoe County, George Brauchler, who was elected in November and takes office Tuesday, after the preliminary hearing begins. Brauchler has not indicated what he will do.

A spokeswoman for outgoing District Attorney Carol Chambers, who oversaw the filing of charges against Holmes, declined to comment.

If prosecutors do not seek the death penalty, and if Holmes is convicted of or pleads guilty to first-degree murder charges, he would face a mandatory sentence of life without parole.

ABIDJAN, Ivory Coast (AP) ? Survivors of a stampede in Ivory Coast that killed 61 people, most of them children and teenagers, after a New Year's Eve fireworks display said Wednesday that makeshift barricades stopped them from moving along a main boulevard, causing the crush of people.

Ivory Coast police said unknown people put tree trunks across the Boulevard de la Republique where the trampling took place.

"For security, because there were so many important people at the event, we closed certain main streets," said a police officer who was overheard briefing Ivory Coast President Alassane Outtara on the incident. The police officer said the tree trunks were put out unofficially by people who are not known.

"After the fireworks we reopened the other streets, but we had not yet removed the tree trunks from the Boulevard de la Republique, in front of the Hotel Tiana near the National Assembly (parliament) building," she said. "That is where the stampede happened when people flooded in from the other streets."

Ouattara ordered three days of national mourning and launched an investigation into the causes of the tragedy.

Two survivors, in interviews with The Associated Press, indicated why so many died in what would normally be an open area, the Boulevard de la Republique. An estimated 50,000 people had gathered near the Felix Houphouet Boigny Stadium and elsewhere in Abidjan's Plateau district to watch the fireworks. As they streamed away from the show some encountered the blockades.

"Near the Justice Palace we were stopped by some people who put blockades of wood in the street," 33-year-old Zoure Sanate said from her bed in Cocody Hospital. "They told us we must stay in the Plateau area until morning. None of us accepted to stay in Plateau until the morning for a celebration that ended at around 1 a.m.

"Then came the stampede of people behind us," she said. "My four children and I were knocked to the ground. I was hearing my kids calling me, but I was powerless and fighting against death. Two of my kids are in hospital with me, but two others are missing. They cannot be found."

Another hospital patient, Brahima Compaore, 39, said he also was caught in the pile of people stopped by the roadblock.

"I found myself on the ground and people were walking on me," said Compaore. "I was only saved by people who pulled me onto the sidewalk."

Local newspapers are speculating that thieves put up the roadblocks so that pickpockets could steal money and mobile phones from the packed-in people.

Ouattara pledged to get answers. Some observers wondered why police did not prevent the tragedy.

"The investigation must take into account all the testimonies of victims," he said Wednesday. "We will have a crisis center to share and receive information."

Ouattara also postponed the traditional New Year's receptions at his residence, which had been scheduled for Thursday and Friday.

The leader of a human rights organization said that deadly incidents were predictable because the police and civil authorities had not taken adequate protective measures.

"The situation is deplorable," said Thierry Legre, president of the Ivorian League of Human Rights. "It is our first tragedy of 2013 but in 2012 we could already see possibility of such a tragedy because there are not adequate authorities patrolling our roads and waters."

Legre said the New Year's stampede "exposes our weak and dysfunctional civil protection system. This must be corrected immediately. The government cannot invite people to this kind of public gathering without taking adequate precautions to protect their safety and their lives."

He called on the government "to implement measures to avoid such tragedies in the future by reinforcing the civil protection system."

The government organized the fireworks to celebrate Ivory Coast's peace, after several months of political violence in early 2011 following disputed elections.

Just one night before the New Year's incident, there had been a big concert at the Felix Houphouet-Boigny Stadium where American rap star Chris Brown performed. That Sunday night event was for the Kora Awards for African musicians. No serious incidents were reported from that event.

In 2009, 22 people died and over 130 were injured in a stampede at a World Cup qualifying match at the Houphouet Boigny Stadium, prompting FIFA, soccer's global governing body, to impose a fine of tens of thousands of dollars on Ivory Coast's soccer federation. The stadium, which officially holds 35,000, was overcrowded at the time of the disaster.

Another African stadium tragedy occurred on New Year's Eve in Angola where 13 people, including four children, died in a stampede during a religious gathering at a sports stadium in Luanda, the capital.

Angop, the Angolan news agency, cited officials as saying Tuesday that 120 people were also injured. The incident happened on New Year's Eve when tens of thousands of people gathered at the stadium and panic ensued. Faustino Sebastiao, spokesman for the national firefighters department, says those who died were crushed and asphyxiated.

U.N. Secretary-General Ban Ki-moon expressed "deep sorrow" at the heavy human toll and put "a medical team and all available logistical means at the disposal of the government," to help deal with the situation, U.N. spokesman Martin Nesirky said.

UN: Analysis suggests 60,000-plus killed in Syria

BEIRUT (AP) ? At least 60,000 people have been killed in Syria's civil war, with monthly casualty figures steadily increasing since the conflict began almost two years ago, according to a new analysis released Wednesday by the United Nations.

The death toll is a third more than the figure of 45,000 given by activists opposed to the regime of President Bashar Assad ? the first time that the global body's estimates are higher.

It comes as activists report that a Syrian warplane blasted a gas station near Damascus on Wednesday, killing and wounding dozens of people and igniting a huge fire in what could be one of the bloodiest attacks in weeks during the 22-month conflict.

Independent experts compared 147,349 killings reported by seven different sources ? including the government ? for the study, which was commissioned by the U.N. human rights office.

By removing duplicates they arrived at a list of 59,648 individuals killed between the start of the uprising on March 15, 2011, and Nov. 30, 2012. In each case, the victim's first and last name, the date and the location of his or her death were known.

"Given there has been no let-up in the conflict since the end of November, we can assume that more than 60,000 people have been killed by the beginning of 2013," U.N. High Commissioner for Human Rights Navi Pillay said in a statement. "The number of casualties is much higher than we expected, and is truly shocking."

The real death toll is likely to be even greater because reports containing incomplete information were excluded and a significant number of killings may not have been documented at all by the sources available.

"There are many names not on the list for people who were quietly shot in in the woods," Pillay's spokesman Rupert Colville told The Associated Press.

The data, which didn't distinguish among soldiers, rebels and civilians, also show that the killing in Syria has accelerated.

During the summer of 2011, shortly after the uprising against Assad began, the monthly death toll stood at around 1,000. A year later, an average of 5,000 were killed each month, the U.N. said.

Most of the killings occurred in Homs, followed by rural Damascus, Idlib, Aleppo, Daraa and Hama. At least three quarters of the victims were male.

"The failure of the international community, in particular the Security Council, to take concrete actions to stop the blood-letting, shames us all," Pillay said. "Collectively, we have fiddled at the edges while Syria burns."

The U.N. rights chief warned that thousands more would die or suffer terrible injuries if the conflict continues, and repeated her call that those responsible for the killings ? which in some cases could amount to war crimes ? should be held accountable.

"We must not compound the existing disaster by failing to prepare for the inevitable ? and very dangerous ? instability that will occur when the conflict ends," she said.

"Serious planning needs to get under way immediately, not just to provide humanitarian aid to all those who need it, but to protect all Syrian citizens from extra-judicial reprisals and acts of revenge" like those seen in Afghanistan, Iraq, Somalia and Congo, she said.

What began with peaceful protests has evolved into a full-scale civil war in Syria, with scores of armed groups fighting regime forces across the Arab country.

Anti-regime activists said Wednesday that a single Russian-built MiG fighter fired a missile that hit the gas station, setting off an inferno in the eastern suburb of Mleiha. Black smoke billowed from the site. An amateur video posted online showed charred bodies and gruesome carnage at the scene.

Mohammed Saeed, an activist who visited the site, said the missile struck as drivers waited in line with their cars at the station. Syria has been facing a fuel crisis, and people often must wait for hours to get gasoline.

Meanwhile, rebels have been targeting airports, including the Mannagh military helicopter base near the Turkish border.

Teen locked in police van for 15 hours files suit

A New Jersey teen who was locked inside a police van cage for 15 hours without access to food, water or a bathroom, has sued the Fort Lee Police Department, its chief and 19 police officers.

Adam Kim, who was 17 at the time, was placed in the cage with four other young men, according to a civil complaint filed in U.S. District Court last month. Without a bathroom, the complaint says, the teens had to relieve themselves in front of each other. They also had to huddle together for warmth, as temperatures hovered below freezing and Kim was wearing just a T-shirt.

His lawyer, Nancy E. Lucianna, told the The Record that Kim, now a college freshman, is traumatized by what happened. Nightmares keep him from sleeping soundly and he has sought out therapy and medication to cope with the ordeal.


Around midnight on March 25, 2011, Fort Lee police officers responded to noise complaints stemming from a house party that Kim was attending.

The officers, according to Kim, referred to him and others as ?chinks? and made ?vulgar remarks? about how the females were dressed. Kim is Korean American.

The officers then loaded their police van with 14 teens ? five, including Kim, were placed in the cage on the right. Five others were the cage on the left. The last four sat in seats in the van.

?Police officers opened both doors of the van and only allowed the left side occupants of the van to be removed,? the complaint says.

At 2 a.m., two police officers returned to the van and responded to a call at a fast food restaurant. Later, they were dispatched to Gotham City Diner. When the teens shouted, ?Officer, officer,? no one responded.

They banged on doors and shouted at passers-by for help, to no avail. Eventually, the complaint says, an elderly man saw them and called police. Medics were called and the five young men were given food and water.?

Lucianna argues that Kim?s civil rights were violated.

?Adam Kim suffered severe mental and emotional anguish, loss of freedom, humiliation, and anxiety,? she wrote in the complaint. ?He has suffered permanent damages due to the discriminatory acts.?

Police Chief Thomas Ripoli, who retired Monday because he had turned 65, the mandatory retirement age, refused to comment to The Record.
